1. General provisions

1.1. Natural persons with legal capacity who are at least 18 years old, and legal entities acting through authorised representatives, have the right to buy in the online shop.

1.2. By placing an order the buyer confirms that they have read these Rules and agree to them. The Rules can be read at any time on this page.

1.3. The Seller has the right to change the Rules. An order is governed by the Rules that were in force when the order was placed.

2. Placing an order and concluding the contract

2.1. The buyer chooses the goods, adds them to the basket, gives the delivery and contact details and chooses the way of payment.

2.2. Before paying, the buyer must tick the box to say they agree to these Rules. Without this confirmation the order is not placed.

2.3. The order is placed by pressing the button "Order with obligation to pay". This action means that the buyer is obliged to pay for the goods ordered.

2.4. The contract of sale is considered concluded from the moment the buyer places the order and pays, and the Seller sends the order confirmation by e-mail. The order confirmation, with the specification of the goods, the price and these Rules, is the confirmation of the contract on a durable medium.

2.5. By placing an order the Buyer agrees that invoices, including VAT invoices, may be sent to the e-mail address given in the order.

3. Prices

3.1. Prices of goods in the online shop are given in euros (EUR).

3.2. MB Gojer is registered for VAT (VAT code LT100020982710). Prices include VAT and are final.

3.3. The price of delivery, where it applies, is shown separately during the order, before payment. The final amount payable is shown in the payment window.

4. Payment

4.1. Payment can be made through the internet banking services of Swedbank, SEB, Luminor, Citadele and Šiaulių bankas. Payments are accepted in euros (EUR).

4.2. Payments are processed through the MakeCommerce.lt payment platform, operated by Maksekeskus AS (Liivalaia 45, Tallinn 10145, Estonia, reg. no. 12268475). When a payment is made, the personal information needed to complete and confirm it is passed to Maksekeskus AS. More information is in our privacy policy.

4.3. In some cases, by agreement, payment is made against a proforma invoice from the Seller (by bank transfer). In that case the goods are prepared once payment has been received.

4.4. The order is processed once full payment has been received, unless otherwise agreed when the order was placed.

5. Delivery

The ways, times and prices of delivering goods are set out on the delivery and returns page. Delivery information is also given to the buyer before payment and in the order confirmation.

6. Withdrawal from the contract and returns

6.1. A consumer has the right to withdraw from a contract concluded at a distance within 14 days without giving a reason, where the law provides for this. The return procedure, the conditions and the model withdrawal form are on the delivery and returns page. A consumer can also withdraw from the contract on the website, with the function "Withdraw from contract here" (the link is at the bottom of every page); we send a confirmation, with the content of the statement and its date and time, by e-mail without delay.

6.2. Important: the right of withdrawal does not apply to goods made or adapted to the buyer's specifications (for example, curtain tracks cut to the length the buyer gives, or curtains sewn to order). This is stated clearly with each such item before the order is placed.

7. Quality of goods and guarantee

7.1. The guarantee under the law applies to the goods sold: the Seller is liable for any lack of conformity of the goods with the quality requirements that existed at delivery and becomes apparent within two years of delivery (CK 6.364 str., Article 6.364 of the Civil Code of the Republic of Lithuania). The buyer may first choose to have the goods repaired or replaced and, in the cases set out in CK 6.364¹ str. (Article 6.364¹), a reduction of the price or termination of the contract. The buyer tells the Seller of a defect within two months of noticing it.

7.2. If the goods are defective, the buyer has the right to contact the Seller by e-mail at [email protected]. The terms of the Seller's guarantee (a commercial warranty) are described on the warranty page; this warranty does not limit rights under the law.

8. Complaints and the settlement of disputes

8.1. Please send claims by e-mail to [email protected]. The Seller answers a written claim within 14 days at the latest.

8.2. Consumer disputes are heard out of court by the State Consumer Rights Protection Authority (Valstybinė vartotojų teisių apsaugos tarnyba, VVTAT, Vilniaus g. 25, 01402 Vilnius, www.vvtat.lt). The buyer may also go to court in the manner the law provides.

9. Final provisions

9.1. The law of the Republic of Lithuania applies to these Rules and to the contract of sale.

9.2. These Rules do not limit mandatory consumer rights that cannot be limited under the applicable law.
