1. Delivery

1.1. Goods are delivered anywhere in Lithuania. The method, the time and the price of delivery are given during the order, before payment, depending on the goods and the place of delivery.

1.2. Goods held in stock (for example ready-made accessories and tracks of standard length) are usually dispatched within 1–3 working days of receiving payment. The total delivery time is made up of the time to prepare (or make) the goods and the time to carry them. Indicative times from order confirmation by type of goods: tracks and poles 1–2 weeks; items sewn to order (curtains, roman blinds) 3–4 weeks. The exact time is shown with the goods or in the order confirmation.

1.3. Delivery times are indicative and may change for reasons outside the Seller's control (for example factors at the courier service). The buyer is told of any delay.

2. The right to withdraw from the contract (14 days)

2.1. A consumer has the right, without giving a reason, to withdraw within 14 days from a contract of sale concluded at a distance or away from business premises (CK 6.228¹⁰ str., Article 6.228¹⁰ of the Civil Code of the Republic of Lithuania). The period runs from the day you receive the goods, and where goods are delivered separately, from the day the last item is received.

2.2. To use this right, the buyer tells us of the decision to withdraw from the contract on the website, with the function "Withdraw from contract here" (the link is at the bottom of every curtain.lt page and on the order status page), by e-mail to [email protected], or by filling in the model withdrawal form (see section 4). When the function is used, we send a confirmation by e-mail without delay, with the content of the statement and the date and time it was made (CK 6.228¹⁰ str. 11–14 d., Article 6.228¹⁰(11)–(14)).

2.3. You may inspect the goods as you would in a shop. If the value of the goods falls because they were handled more than was needed to establish their nature, properties and functioning, the buyer is liable for that loss of value (CK 6.228¹¹ str. 8 d., Article 6.228¹¹(8) of the Civil Code). Return the goods within 14 days at the latest of telling us that you are withdrawing. The buyer pays the direct cost of returning the goods, unless agreed otherwise.

2.4. This right applies to standard goods held in stock, for example tracks and poles of standard length, ready-made accessories and brackets. Such goods can be returned within 14 days of receipt.

3. When the right of withdrawal does not apply

Important: the 14-day right of withdrawal does not apply to goods made or adapted to the buyer's specifications. This covers curtain tracks cut to the length the buyer gives, curtains sewn to order, roman blinds and other goods made to the buyer's measurements or choices.

For tracks and poles of standard length and other goods held in stock this exception does not apply: they are returned in the usual way within 14 days (see section 2).

3.1. It is stated clearly with the goods, and before the order is placed, that the right of withdrawal does not apply to a particular item. This exception rests on CK 6.228¹⁰ str. 2 d. 3 p. (Article 6.228¹⁰(2)(3)) on goods made to the consumer's specifications.

3.2. The exception concerns the right of withdrawal only. Rights in respect of poor quality apply to goods made to order in the same way as to other goods (see section 6).

4. Model withdrawal form

To withdraw from the contract, you can fill in this form and send it by e-mail to [email protected]:

To: MB Gojer, Girulių g. 10, LT-12112 Vilnius, [email protected]

I / we hereby give notice that I / we withdraw from the contract of sale of the following goods: ____________________________________________

Date ordered / date received: ____________________

Name of consumer(s): ____________________

Address of consumer(s): ____________________

Signature of consumer(s) (only if this form is submitted on paper): ____________________

Date: ____________________

5. Refunds

5.1. Where the right of withdrawal has been properly used, we refund the money paid (including the standard delivery costs) within 14 days at the latest of the moment we receive the notice of withdrawal from the contract.

5.2. We refund the money by the same means of payment that the buyer used, unless the buyer has expressly agreed to another. The buyer incurs no additional costs because of the refund.

5.3. The Seller may withhold the refund until the goods have been returned or the buyer provides proof that the goods have been dispatched.

6. Goods of poor quality

If the goods do not meet the quality requirements, the guarantee under the law applies: the seller is liable for a lack of conformity that existed at delivery and becomes apparent within two years of delivery (CK 6.364 str., Article 6.364). You may first choose to have the goods repaired or replaced. You may require a reduction of the price or termination of the contract when repair or replacement is not successful, the defect recurs or it is serious (CK 6.364¹ str., Article 6.364¹).

Tell us of the defect within two months of noticing it, by e-mail to [email protected]. More is on the warranty page.

7. Settlement of disputes

Consumer disputes are heard out of court by the State Consumer Rights Protection Authority (Valstybinė vartotojų teisių apsaugos tarnyba, VVTAT, Vilniaus g. 25, 01402 Vilnius, www.vvtat.lt). The buyer may also go to court in the manner the law provides.
